Are You Ready? – The Upcoming Finnish Family Leave Reform Is Just Around the Corner

Perhevapaauudistus lähenee – Mitä työnantajien tulisi tietää?

Perhevapaita koskeva lakimuutos tulee voimaan Suomessa vuoden 2022 kesän loppupuolella. Perhevapaauudistuksen tavoitteena on muun muassa tarjota vanhemmille lisää joustavuutta, lisätä työelämän tasa-arvoa ja huomioida nykyistä paremmin erilaiset perhemuodot.

Perhevapaauudistuksen vaikutukset

Perhevapaauudistus tuo mukanaan tiettyjä uraauurtavia muutoksia. Perhevapaauudistuksen myötä perhevapaita voidaan jakaa vapaammin perheen sisällä ja päivärahapäiviin tulee muutoksia, minkä lisäksi myös vanhemmuutta koskevaa terminologiaa laajennetaan.

Terminologisten muutosten myötä jaottelu äitien ja isien välillä poistuu, ja äitiysrahan, erityisäitiysrahan, isyysrahan ja vanhempainrahan sijaan jatkossa käytetään termejä vanhempainraha, raskausraha ja erityisraskausraha.

Perheuudistuksen myötä vanhempainrahaa maksetaan lapsen syntymän tai adoption perusteella pääsääntöisesti enintään 320 arkipäivältä. 320 päivän vanhempainraha voidaan pääsääntöisesti myöntää biologisille tai adoptiovanhemmille, jotka ovat lapsen huoltajia, tai muulle henkilölle, joka on tunnustanut vanhemmuuden äitiys- tai isyyslain mukaisesti. Vanhempainraha jaetaan tasapuolisesti vanhempien kesken, eli kumpikin vanhempi saa enintään 160 päivää vanhempainrahaa. Tämän lisäksi raskaana oleva vanhempi on oikeutettu 40 päivän raskausrahaan edellyttäen, että raskaus on kestänyt vähintään 154 päivää.

Vanhempien ei ole pakko käyttää koko 160 päivän kiintiötä itse, vaan he voivat myös luovuttaa omasta päivärahapäivien kiintiöstään enimmillään 63 päivää toiselle lapsesta huolehtivalle henkilölle. Jatkossa päivärahakiintiöstä luovutettavat päivät voidaan luovuttaa aiempaa vapaammin, sillä päivärahapäiviä voidaan luovuttaa esimerkiksi lapsen toiselle vanhemmalle, vanhemman kumppanille, joka ei ole lapsen vanhempi, lapsen toisen vanhemman kumppanille tai muulle henkilölle, joka on lapsen huoltaja.

Jatkossa vanhempainrahaa voidaan käyttää siihen saakka, kunnes lapsi täyttää kaksi vuotta tai kunnes adoptiolapsen hoitoon ottamisesta on kulunut kaksi vuotta. Ellei toisin sovita, työntekijä voi jakaa vanhempainvapaan enintään neljään eri jaksoon, joista kunkin on oltava pituudeltaan vähintään 12 arkipäivää.

Ruotsin perhevapaita koskeva lainsäädäntö vertailukohteena

Eräistä lainsäädännöllisistä eroista huolimatta Suomen perhevapaauudistus on hyvin lähellä Ruotsin perhevapaita koskevaa lainsäädäntöä. Ruotsissa perhevapaan pituus on 480 päivää kunkin lapsen osalta. Vanhemmat voivat jakaa päivärahapäivät vapaasti keskenään lukuun ottamatta 90 päivän vanhempikohtaista jaksoa, jota ei voi luovuttaa ja joka vanhenee, mikäli vanhempi ei sitä itse käytä. Järjestelmä mahdollistaa päivärahapäivien luovuttamisen myös vanhempien kumppaneille, jotka eivät ole lapsen vanhempia. Erona Suomeen on se, että vanhempainvapaa on pidettävissä siihen asti, kunnes lapsi on täyttänyt 12 vuotta tai kunnes lapsen viides kouluvuosi on suoritettu. 

Miten työnantajien tulisi valmistautua uudistukseen?

Muutokset Suomen perhevapaita koskevaan lainsäädäntöön tulevat voimaan 1.8.2022. Perhevapaauudistus koskee perheitä, joissa lapsen laskettu aika on 4.9.2022 tai sen jälkeen. Lasketusta ajasta riippumatta vanhaa perhevapaita koskevaa lainsäädäntöä sovelletaan vanhempiin, joiden lapsi syntyy ennen 1.8.2022. Adoptiolasten osalta lakimuutos koskee perheitä, joissa lapsi otetaan hoitoon 31.7.2022 tai sen jälkeen.

Nähtäväksi jää, kuinka paljon muutoksia perhevapaauudistus käytännössä saa aikaan työelämässä ja työpaikoilla. Joka tapauksessa suomalaisten työnantajien kannattaa tarkistaa ja päivittää sisäiset perhevapaata koskevat käytäntönsä vastaamaan perhevapaauudistusta. Käytännöissä käytettävä terminologia voi vaatia päivitystä, ja lisäksi työntekijöiden tasa-arvoinen kohtelu tulee varmistaa esimerkiksi palkkaan liittyvien käytäntöjen osalta.

Are You Ready? – The Upcoming Finnish Family Leave Reform Is Just Around the Corner

A legislative amendment regarding family leave will enter into force in Finland at the end of the summer this year. The aim of the family leave reform is, among other things, to ensure more flexibility for parents, to increase equality in working life, and to a greater extent take various types of families into consideration.

Implications of the Finnish Family Leave Reform

The family leave reform brings about certain ground-breaking changes. In addition to a right to share the family leave between different persons and changes to the allowance periods, the reform will introduce new terminology broadening the concept of parenthood.

The terminological changes diminish the distinction between mothers and fathers: instead of maternity, special maternity, paternity, and parental allowance, there will in the future be simply parental allowance and pregnancy and special pregnancy allowance.

As regards the extent of the allowance periods, parental allowance will, pursuant to the family leave reform, as a main rule, be paid based on the birth or adoption of a child for a maximum of 320 working days. The 320 days of parental allowance will be granted to the biological or adoptive parents who are the legal guardians of the child, or to another person who has adequately acknowledged the parentage. The days of parental allowance will be divided equally between the parents, i.e. each parent gets a maximum of 160 days of parental allowance. In addition to the days of parental allowance, the pregnant parent will be entitled to 40 days of pregnancy allowance provided that the pregnancy has lasted at least 154 days.

The parents will not be obligated to use the entire 160 days’ quota themselves, but they may transfer a maximum of 63 days of parental allowance to another person who takes care of the child. The group of persons to whom one may transfer their parental allowance days will be remarkably broader in the future, as the allowance days may be transferred to, e.g., the child’s other parent, one’s partner who is not the child’s parent, the partner of the child’s other parent, or another person who is the child’s legal guardian.

Going forward, parental allowance may be used until the child turns two years of age or until two years have passed from the date when the adopted child was taken into the care of the family. The employee may take the parental leave in a maximum of four parts, and each part shall last a minimum of 12 working days.

The Swedish Family Leave Regulation as a Comparison

Despite some regulatory differences, it appears the Finnish family leave reform is a step in the same direction as the current Swedish family leave regulation. In Sweden, the duration of parental leave is 480 days per child. The number of days can be divided freely between the parents, save for a period of 90 days per parent that cannot be transferred and will lapse unless used by the parent to whom they have been designated. The system also allows for the transfer of parental leave days to non-parent partners of the parents. One key difference in Sweden is that parental leave may be taken during a significantly longer timeframe than in Finland, i.e. until the child is 12 or has finished their fifth school year. 

How Should Employers Prepare for the Reform?

The amendments to the Finnish family leave regulation will enter into force on 1 August 2022. They will apply to children whose expected due date is 4 September 2022 or later. Regardless of the expected due date, should the child be born before 1 August 2022, the old family leave regulation will apply. As regards adoptive children, the legislative amendments will apply to children who are placed in the adoptive family on 31 July 2022 or later.

It remains to be seen to what extent the family leave reform will lead to habitual changes in the Finnish working life and workplaces. In any event, employers in Finland are recommended to review and update internal family leave policies in accordance with the legislative amendments. Not only may the terminology require updates, but also the equal treatment of employees needs to be assured with respect to, e.g., salary payment practices.
